PURCHASE INFORMATION
1. Terms and Conditions of Sale
1.1 This document sets forth the terms and conditions of sale (hereinafter the “Agreement”) that apply between the clients of the gup-tuning.ee online store (hereinafter the “Client”) and the owner of the gup-tuning.ee online store, Gup-Tuning OÜ (hereinafter the “Service Provider”), for the purpose of establishing rules for the purchase and sale of goods and resolving potential disputes between the parties.
1.2 The parties to the Agreement shall be guided in their mutual relations by the Law of Obligations Act, other applicable laws and regulations of the Republic of Estonia, and the provisions set forth in these Terms and Conditions of Sale.
1.3 By placing an order and making a prepayment in the Service Provider’s online store, the Client confirms that they have read, understood, and agree to these Terms and Conditions of Sale.
2. Price List of the Service Provider
2.1 All prices displayed in the Service Provider’s online store are in euros (€), exclusive of delivery costs, and include value-added tax (VAT) at the rate of 24%.
2.2 The delivery cost is calculated according to the delivery method selected by the Client. The amount is shown in the Shopping Cart and also in the invoice or order confirmation sent to the Client. The Client will always see the delivery cost before making payment.
2.3 The Service Provider reserves the right to change the displayed prices at any time. If the Client has submitted and paid for an order, the Service Provider undertakes to deliver the goods at the prices valid at the time of the order.
3. Payment for Goods
3.1 The Client may pay for the goods by:
• bank transfer (via internet banking);
• online bank link payment;
• credit card payment;
• Inbank hire-purchase agreement or instalment payment in three equal parts;
• prepayment invoice, which will be sent to the Client’s e-mail address.
4. Ordering Goods and Product Compatibility
4.1 All goods are sold “as is.” The Client must carefully review the product’s specifications and verify its compatibility before purchase. The Service Provider is not responsible for incorrect or incompatible product orders placed by the Client.
5. Delivery Time and Terms of Delivery
5.1 The Client has the right to choose between different delivery options offered by the Service Provider.
5.2 Goods are typically delivered within 7–9 business days within the Republic of Estonia, provided the item is in stock. In the event of supply chain delays, the delivery period may be extended.
5.3 The Service Provider also delivers goods outside the Republic of Estonia.
Delivery to European Union countries generally takes between 7–21 business days, depending on the destination country and the courier service provider.
The Service Provider shall not be held liable for delivery delays caused by customs procedures, transportation company operations, or other circumstances beyond the Service Provider’s control.
The international delivery cost is calculated based on the Client’s selected delivery method and destination country and is displayed before the order is confirmed.
6. Order Cancellation and Product Returns
6.1 The Client has the right to cancel an order within 14 days after payment by sending an e-mail to info@gup-tuning.ee
. The e-mail must include the invoice or order number. The payment will be refunded to the Client’s bank account within 30 days of receiving the cancellation notice.
6.2 The Service Provider will cover the return shipping costs if the product is defective in a way that could not have been detected upon receipt, if the defect did not result from opening the package, or if the delivered product does not match the order (e.g. wrong product).
6.3 If the returned product has been damaged due to improper use, installation, modification, incorrect assembly, or disassembly by the Client, the Service Provider has the right to reduce the refund amount proportionally to the extent of the damage. Shipping costs related to the return of goods are non-refundable.
Returned goods must meet the following conditions:
• The product must not have been used;
• The product must be in its undamaged original packaging;
• For products removed from the packaging, the principle of reasonableness applies.
6.4 The Service Provider reserves the right to cancel the Client’s order if:
The Client has not paid the invoice by the specified due date;
The ordered product is out of stock and the Client does not agree to a replacement product offered by the Service Provider (in such cases, the prepayment will be refunded to the Client’s bank account within 14 business days of receiving a written request);
The Client knowingly and after prior consultation orders a product that, according to the product description and manufacturer’s information, is not compatible with their vehicle.
7. Privacy Policy / Data Security
7.1 The Client gives explicit and informed consent to the Service Provider for the processing of their personal data.
7.2 Personal data provided by the Client when placing an order are entered into the customer database and used to provide sales services and offer products to the Client.
7.3 Secure SSL data communication and the MasterCard SecureCode and Verified by Visa security systems are used for processing card data.
7.4 The Service Provider does not have access to the Client’s card details. For payment processing, the cardholder is redirected to the secure environment of the Bank Card Centre (Pankade Kaardikeskus AS). Card details are entered and stored securely on the Bank Card Centre’s server.
7.5 The source of personal data is the establishment of a customer relationship upon order registration in the online store.
7.6 The registered personal data include the Client’s name, address, phone number, year of birth, delivery method, payment method used, and consent to the online store’s terms of use.
7.7 Personal data are processed by Gup-Tuning OÜ.
7.8 Personal data necessary for delivery are transferred to the courier company providing the delivery service.
7.9 The protection of personal data is ensured through security measures.
7.10 The Service Provider undertakes not to disclose the registered personal data of the Client to any third parties.
7.11 The Service Provider reserves the right to disclose the Client’s data if required to do so by law or to protect the Client’s life, health, or freedom.
7.12 The Client has the right to review, modify, or request the deletion of their personal data from the register.
7.13 The Client grants the Service Provider permission to send an order confirmation to the e-mail address provided when placing the order.
8. Other Terms
8.1 Reviewing these Terms and Conditions is mandatory for the Client. By ticking the corresponding box during checkout, the Client confirms that they have read, understood, and agree to these Terms and Conditions.
8.2 Any disagreements or disputes arising from the performance of these Terms and Conditions shall be resolved primarily through negotiations. If the parties fail to reach an agreement, both the Client and the Service Provider have the right to contact the Consumer Protection and Technical Regulatory Authority or take the matter to court.
